The purpose of these general conditions of use (hereinafter referred to as " GCU ") is to provide a legal framework for the terms and conditions under which the www.gaultmillau.com and its sub-domains as well as the mobile applications (hereinafter and for all " the Site ") by Gault&Millau and to define the conditions of access and use of the services by the " User ".
These Terms and Conditions are available on the Site under the heading " General Terms and Conditions of Use ".
Any use of the Site implies the User's unreserved and unrestricted acceptance of these GCU. Acceptance of these GCU implies that Users have the legal capacity to do so. If the User is a minor or does not have such legal capacity, he/she declares that he/she has the authorization of a tutor, curator or legal representative.
In the event of non-acceptance of the GCU stipulated in the present contract, the User must renounce access to the services offered by the Site.
The Site reserves the right to unilaterally modify the content of these GCU at any time.
Access to the Site
The Site provides the User with free access to the following services:
- Search and consultation of establishments and/or products;
- The possibility of evaluating establishments and/or products;
- News consultation.
The Site is accessible free of charge from any location to any User with Internet access. All costs incurred by the User in accessing the service (hardware, software, Internet connection, etc.) are at the User's expense.
Non-member Users(i.e. those without a user account) do not have access to the reserved services. To do so, they must register by completing the registration form. By agreeing to register for the reserved services, the member User undertakes to provide truthful and accurate information, in particular his e-mail address. To access the services, the User must then identify himself using his login and password.
Any User who is a regularly registered member may also request to be removed from the list at the following address: france@gaultmillau.fr. Unsubscription will take effect within a reasonable period of time.
Gault&Millau shall not be held liable for any event due to force majeure resulting in malfunction of the Site or server, subject to any interruption or modification for maintenance purposes. In such cases, the User agrees not to hold the Publisher responsible for any interruption or suspension of service, even without notice.
The User may contact the Site by e-mail at the Publisher's e-mail address given in the "Legal information" paragraph.
Intellectual property rights
Trademarks, logos, signs and all Site content (text, images, sound, etc.) are the property of Gault&Millau and its affiliates.
The Gault&Millau brand is a registered trademark of Gault&Millau International SA. Any representation and/or reproduction and/or use of this trademark, in whole or in part, of any kind whatsoever, is strictly prohibited.
The User must request prior authorization from the Site for any reproduction, publication or copy of the various contents. The User undertakes to use the contents of the Site in a strictly private context; any use for commercial or advertising purposes is strictly forbidden.
Any total or partial representation or reproduction of this Site by any process whatsoever, without the express authorization of the Website operator, shall constitute an infringement punishable under European and international intellectual property and database protection law.
Users who reproduce, copy or publish protected content must cite the author and source.
Responsibility
The sources of the information published on the Site are deemed reliable, but the Site does not guarantee that it is free from defects, errors or omissions.
The information communicated is presented for information purposes only and has no contractual value. Despite regular updates, the Site cannot be held responsible for changes in administrative and legal provisions occurring after publication. Similarly, the Site cannot be held responsible for the use and interpretation of the information contained in this Site.
Users are responsible for keeping their password secret. Any disclosure of the password, in whatever form, is prohibited. The User assumes all risks associated with the use of his/her login and password. The Site declines all responsibility.
The Site cannot be held responsible for any viruses that may infect the computer or any other hardware of the Internet user, following use, access or downloading from this Site.
The Site Editor shall not be held liable for any technical unavailability of the connection, whether due to force majeure, maintenance, updating, modification or any other reason. modification of the Site, intervention by the host, internal or external strike, network failure or power cut. The Publisher shall not be held liable for the non-operation, impossibility of access or malfunction of the Site attributable to unsuitable equipment, to incorrect configuration or use of the User's computer, malfunctions of the User's Internet service provider, or malfunctions of the Internet network.
User contribution to Site content
Users may contribute to the content of the Site by posting comments. The Editor is not responsible for Users' publications, their content or their veracity, even after moderation by the Editor and the moderators.
Users are hereby informed that the Publisher, represented where applicable by the moderators, may choose to publish the content in question on the newsletters of this Site and on the Sites of all its partners, on condition that the Publisher cites the pseudonym of the author of the contribution. The author hereby waives his or her rights to the content of the contributions, in favor of the Site Editor, for any distribution or use, even commercial, on the Internet, this, of course, always respecting the author's paternity.
Hypertext links
The Site may include hypertext links to other sites. The User hereby acknowledges that the Publisher shall not be held liable for any damage or loss, whether actual or alleged, arising from or in connection with the use or knowledge of the content, advertising, products or services available on these external sites or sources. Likewise, the Editor of the present Site shall not be held liable if the User's visit to one of these Sites causes him/her harm. Notifications and complaints
Any notification or notice concerning these GCU, the legal notices or the personal data charter must be made in writing and sent by registered or certified mail, or by e-mail to the following address or certified mail, or by e-mail to the address indicated in the Site's legal notice, specifying the contact details, first name and surname of the notifier, as well as the subject of the notice. Any claim relating to the use of the Site, the Services, the Site's pages on any social networks, or to the GCU, the Legal Notice or the Privacy Policy must be filed within 365 days of the date of origin of the matter giving rise to the claim, regardless of any statute or law to the contrary. In the event that such claim is not filed within 365 days, such claim will forever be unenforceable at law. It is possible that, to a limited extent, the Website and Services may contain inaccuracies or errors, or information that is inconsistent with the GCU, the Legal Notice or the Privacy Policy. Furthermore, it is possible that unauthorized modifications may be made by third parties on the Site or on related Services (social networks, etc.). In such a situation, the User may contact the Site Editor by post or by e-mail at the addresses indicated in the Site's Legal Notice, if possible with a description of the error and its location (URL), as well as sufficient information to enable the User to contact the Site Editor.
Independence of clauses
If any provision of the TOU shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the TOU and shall not affect the validity and enforceability of any remaining provisions. The TOS supersede all prior or contemporaneous written or oral agreements. They are not assignable, transferable or sub-licensable by the User. A printed version of the GTU and of all notices given in electronic form may be requested in judicial or administrative proceedings relating to the GTU. The parties agree that all correspondence relating to these GTU shall be written in the French language.
Applicable law
These GCU are governed by and subject to French law. You also benefit from rights protecting you under the mandatory provisions of the law applicable in your country of residence.
Except in the case of public policy provisions, any disputes that may arise in connection with the execution of these GTUs may, prior to any legal action, be submitted to the Publisher for amicable settlement. It is expressly recalled that requests for amicable settlement do not suspend the time limits for bringing legal action. Unless otherwise provided by public policy, any legal action relating to the performance of these GTUs shall be subject to the jurisdiction of the courts of the place of domicile of the defendant.
